4. No Therapist-Client Relationship
Use of this website, submission of a contact form, or participation in workshops does not establish a therapist-client relationship. A formal therapeutic relationship is only created through a completed intake process via SimplePractice, our HIPAA-compliant platform.
5. Therapy Services Disclaimer
LCSW License #BBH-LCSW-LIC-55003. Therapy services are only available to individuals physically located in Montana or Idaho at the time of service. Accessing this website from another location does not constitute eligibility for clinical services.
6. Workshops Disclaimer
Workshops offered by Peaks and Prairies Therapy are educational in nature and do not constitute therapy, diagnosis, or treatment. By participating in a workshop, you acknowledge that:
Workshops are not a substitute for mental health treatment.
Participation does not establish a therapist-client relationship.
Results and outcomes are not guaranteed.
7. HIPAA and Clinical Communication Disclaimer
This website is not HIPAA-compliant and is not monitored for clinical or emergency communications. Do not use website forms or email to submit protected health information (PHI) or sensitive personal health information. All clinical services, communications, and records are handled exclusively through SimplePractice.
This website does not constitute an emergency service. If you are experiencing a mental health emergency, please call 911 or your local emergency services immediately. You may also contact the 988 Suicide and Crisis Lifeline by calling or texting 988.
8. User Responsibilities
By using this website, you agree to:

Peaks and Prairies Therapy uses the following third-party platforms to operate our services. We are not responsible for the independent actions, outages, or policies of these platforms:
Squarespace: website hosting and email collection
SimplePractice: scheduling, telehealth, payments, and client portal
Google Analytics: website traffic analysis
12. Limitation of Liability
To the maximum extent permitted by applicable law, the Company’s total liability for any claims under these Terms shall be limited to the amount actually paid by you through the Service, or $100 USD if you have not made any purchases.
In no event shall Peaks and Prairies Therapy or its affiliates be liable for any special, incidental, indirect, or consequential damages whatsoever, including but not limited to loss of data, business interruption, or personal injury, even if we have been advised of the possibility of such damages.
Some states do not allow the exclusion of implied warranties or limitations of liability for incidental or consequential damages. In such states, our liability will be limited to the greatest extent permitted by law.
13. “As Is” and “As Available” Disclaimer
The Service is provided “AS IS” and “AS AVAILABLE” without warranty of any kind. To the maximum extent permitted by law, Peaks and Prairies Therapy expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components. No guarantees are made regarding outcomes from therapy, workshops, or any information provided on this website.
14. Indemnification
You agree to indemnify, defend, and hold harmless Peaks and Prairies Therapy and its affiliates from and against any claims, damages, liabilities, costs, or expenses (including reasonable attorney’s fees) arising from your use of the website or services, your violation of these Terms, or your violation of any rights of another party.
15. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms and Conditions. Upon termination, your right to use the Service will cease immediately.
16. Severability and Waiver
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to accomplish its objectives to the greatest extent possible, and the remaining provisions will continue in full force and effect.
Waiver
Failure to exercise a right or require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter. A waiver of any breach does not constitute a waiver of any subsequent breach.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Montana and the United States, excluding conflicts of law rules. If you have a concern or dispute, you agree to first attempt to resolve it informally by contacting us at krystle@peaksandprairiestherapy.com.
If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you reside.
18. United States Legal Compliance
You represent and warrant that (i) you are not located in a country subject to a United States government embargo or designated as a “terrorist supporting” country, and (ii) you are not listed on any United States government list of prohibited or restricted parties.

20. Changes to These Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. 21. Translation
These Terms and Conditions may be translated if made available in other languages on our Service. In the event of a dispute, the original English text shall prevail.
